Good day and welcome to our website. Our data protection policy explains the nature, scope and purpose of the collection and processing of personal data when you visit and use our website, the associated web pages, functions and content, as well as external online presentations.
Our data protection policy is based on terms used by the European General Data Protection Regulation (GDPR) and the new Federal Data Protection Act (BDSG-neu).
§ 1 Information on the Collection of Personal Data
- Personal data means all data that can be related to you personally, e.g. name, address, email addresses, user behavior.
- The controller pursuant to Art. 4 para. 7 EU General Data Protection Regulation (GDPR) is IONE GmbH, Managing Director: Wanja Glatte, Jöllenbecker Str. 314, 33613 Bielefeld, Germany, Telephone +49 (0) 52 12 70 57 57 0, Fax +49 (0) 52 12 70 57 57 90, Email: info@ione-software.com (see our imprint).
- When you contact us by email or via a contact form, the data you provide (your email address, possibly your name and telephone number) will be stored by us in order to answer your questions. We delete the data arising in this context after storage is no longer required, or restrict processing if there are legal retention obligations.
- If we use contracted service providers for individual functions of our offer or would like to use your data for advertising purposes, we will inform you in detail about the respective processes below. We will also state the specified criteria for the storage period.
§ 2 Your Rights
- You have the following rights with respect to us regarding your personal data:
- pursuant to Art. 15 GDPR, the right to request confirmation as to whether data concerning you is being processed and to information about this data as well as further information and a copy of the data.
- pursuant to Art. 16 GDPR, the right to request the completion of the data concerning you or the correction of incorrect data concerning you.
- pursuant to Art. 17 GDPR, the right to demand that the data concerned be deleted immediately, or alternatively, pursuant to Art. 18 GDPR, to demand a restriction of the processing of the data.
- pursuant to Art. 20 GDPR, the right to demand that you receive the data concerning you that you have provided to us in a structured, common and machine-readable format and to demand their transmission to other controllers.
- pursuant to Art. 77 GDPR, the right to lodge a complaint with the competent supervisory authority.
§ 3 Collection of Personal Data When Visiting Our Website
- When using the website for informational purposes only, i.e. if you do not register or otherwise transmit information to us, we only collect the personal data that your browser transmits to our server.
- If you wish to view our website, we collect the following data, which is technically necessary for us to display our website to you and to ensure stability and security (legal basis is Art. 6 para. 1 sentence 1 lit. f GDPR):
- IP address
- Date and time of the request
- Time zone difference to Greenwich Mean Time (GMT)
- Content of the request (specific page)
- Access status/HTTP status code
- Amount of data transferred in each case
- Website from which the request comes
- Browser
- Operating system and its interface
- Language and version of the browser software.
§ 4 Cookies
- In addition to the data mentioned above, cookies are stored on your computer when you use our website. Cookies are small text files that are stored on your hard drive, assigned to the browser you are using, and through which certain information flows to the entity that sets the cookie (in this case, us). Cookies cannot execute programs or transfer viruses to your computer. They serve to make the internet offering more user-friendly and effective overall.
- Use of cookies:
- This website uses the following types of cookies, the scope and functionality of which are explained below:
- Transient cookies (see b)
- Persistent cookies (see c).
- Transient cookies are automatically deleted when you close the browser. These include in particular session cookies. These store a so-called session ID, with which various requests from your browser can be assigned to the common session. This allows your computer to be recognized when you return to our website. The session cookies are deleted when you log out or close the browser.
- Persistent cookies are automatically deleted after a specified period, which may differ depending on the cookie. You can delete the cookies in the security settings of your browser at any time.
- You can configure your browser settings according to your wishes and, for example, refuse the acceptance of third-party cookies or all cookies. We point out that you may not be able to use all functions of this website.
§ 5 Further Functions and Offers of Our Website
- In addition to the purely informational use of our website, we offer various services that you can use if interested. For this purpose, you will generally have to provide further personal data, which we use to provide the respective service and for which the aforementioned principles for data processing apply.
- The personal data entered by you will be collected and stored exclusively for internal use by the controller and for their own purposes. The controller may arrange for disclosure to one or more processors, for example, a parcel service provider, who also uses the personal data exclusively for internal use attributable to the controller.
- In some cases, we use external service providers to process your data. If, in the course of our processing, we disclose data to other persons and companies (processors or third parties), transmit it to them, or otherwise grant them access to the data, this is done only on the basis of a legal permission (e.g. if a transmission of the data to third parties, such as payment service providers, is necessary for the performance of the contract in accordance with Art. 6 para. 1 lit. b GDPR), you have consented, a legal obligation provides for this, or on the basis of our legitimate interests (e.g. when using agents, web hosts, etc.).
- If we commission third parties with the processing of data on the basis of a so-called "order processing contract", this is done on the basis of Art. 28 GDPR. These are carefully selected and commissioned by us, are bound by our instructions and are regularly monitored.
- Furthermore, we may pass on your personal data to third parties if participations in campaigns, competitions, contract conclusions or similar services are offered by us together with partners. You will receive more detailed information on this when you provide your personal data or below in the description of the offer.
- If we process data outside the European Union (EU) or the European Economic Area (EEA) (so-called third country) or such occurs in the context of using third-party services or disclosing or transferring data to third parties, this only happens if it is necessary for the fulfillment of our (pre)contractual obligations, on the basis of your consent, due to a legal obligation or on the basis of our legitimate interests. Otherwise, we only process or have data processed in a third country if the requirements of Art. 44 ff. GDPR are met.
§ 6 Legal Basis for Processing
- Art. 6 para. 1 a GDPR serves as the legal basis for our company for processing operations in which we obtain consent for a specific processing purpose. If the processing of personal data is necessary for the performance of a contract to which the data subject is party, as is the case, for example, with processing operations that are necessary for the supply of goods or the provision of any other service or consideration, the processing is based on Art. 6 para. 1 b GDPR.
- The same applies to such processing operations that are necessary for carrying out pre-contractual measures, for example in cases of inquiries about our products or services.
- If our company is subject to a legal obligation by which the processing of personal data becomes necessary, such as for the fulfillment of tax obligations, the processing is based on Art. 6 para. 1 c GDPR.
- In some cases, the processing of personal data may become necessary to protect the vital interests of the data subject or another natural person. This would be the case, for example, if a visitor were injured in our company and his name, age, health insurance data or other vital information had to be passed on to a doctor, hospital or other third party. Then the processing would be based on Art. 6 para. 1 d GDPR.
- Processing operations could also be based on Art. 6 para. 1 f GDPR. Processing operations that are not covered by any of the aforementioned legal bases are based on this legal basis if the processing is necessary to safeguard a legitimate interest of our company or a third party, provided that the interests, fundamental rights and freedoms of the data subject do not override. Such processing operations are permitted to us because they were specifically mentioned by the European legislator. In this respect, he was of the opinion that a legitimate interest could be assumed if the data subject is a customer of the controller (Recital 47 Sentence 2 GDPR).
- If the processing of personal data is based on Article 6 para. 1 f GDPR, our legitimate interest is the conduct of our business for the benefit of the well-being of all our employees and our shareholders.
§ 7 Objection or Revocation Against the Processing of Your Data
- If you have given consent to the processing of your data, you can revoke it at any time. Such a revocation will affect the permissibility of processing your personal data after you have expressed it to us.
- Insofar as we base the processing of your personal data on a balancing of interests, you may object to the processing. This is the case if the processing is not necessary, in particular, for the performance of a contract with you, which is described by us in the following description of the functions. When exercising such an objection, we ask you to explain the reasons why we should not process your personal data as we have done. In the event of your justified objection, we will examine the situation and will either stop or adjust the data processing or show you our compelling legitimate grounds on the basis of which we continue the processing.
- Of course, you can object to the processing of your personal data for advertising and data analysis purposes at any time. You can inform us of your objection to advertising at the following contact details: IONE GmbH, Managing Director: Wanja Glatte, Jöllenbecker Str. 314, 33613 Bielefeld, Germany, Telephone +49 (0) 52 12 70 57 57– 0, Fax +49 (0) 52 12 70 57 57– 90, Email: info@ione-software.com.
§ 8 Tracking Tools
- The tracking measures listed below and used by us are carried out on the basis of Art. 6 para. 1 sentence 1 lit. f GDPR. With the tracking measures used, we want to ensure a needs-based design and the continuous optimization of our website. On the other hand, we use the tracking measures to statistically record the use of our website and to evaluate it for the purpose of optimizing our offer for you. These interests are to be regarded as legitimate in the sense of the aforementioned provision.
- The respective data processing purposes and data categories can be found in the corresponding tracking tools.
§ 9 Use of Google Analytics
- This website uses Google Analytics, a web analytics service provided by Google Inc. ("Google"). Google Analytics uses "cookies", which are text files placed on your computer, to help the website analyze how users use the site. The information generated by the cookie about your use of this website is usually transmitted to a Google server in the USA and stored there. However, if IP anonymization is activated on this website, your IP address will be truncated by Google beforehand within member states of the European Union or in other contracting states of the Agreement on the European Economic Area. Only in exceptional cases will the full IP address be transmitted to a Google server in the USA and truncated there. On behalf of the operator of this website, Google will use this information to evaluate your use of the website, to compile reports on website activity and to provide other services relating to website activity and internet usage to the website operator.
- The IP address transmitted by your browser as part of Google Analytics will not be merged with other Google data.
- You can prevent the storage of cookies by setting your browser software accordingly; however, we would like to point out that in this case you may not be able to use all functions of this website to their full extent. You can also prevent Google from collecting the data generated by the cookie and relating to your use of the website (including your IP address) and from processing this data by Google by downloading and installing the browser plug-in available at the following link: https://tools.google.com/dlpage/gaoptout?hl=en.
- This website uses Google Analytics with the "_anonymizeIp()" extension. This means that IP addresses are processed in a truncated form, thus excluding direct personal identification. Insofar as the data collected about you is assigned a personal reference, this is immediately excluded and the personal data is thus deleted immediately.
- We use Google Analytics to analyze and regularly improve the use of our website. The statistics obtained allow us to improve our offer and make it more interesting for you as a user. For the exceptional cases in which personal data is transferred to the USA, Google has submitted to the EU-US Privacy Shield, https://www.privacyshield.gov/EU-US-Framework. The legal basis for the use of Google Analytics is Art. 6 para. 1 sentence 1 lit. f GDPR.2
- Third-party provider information: Google Dublin, Google Ireland Ltd., Gordon House, Barrow Street, Dublin 4, Ireland, Fax: +353 (1) 436 1001. Terms of use: https://www.google.com/analytics/terms/de.html, overview of data protection: https://www.google.com/intl/de/analytics/learn/privacy.html, and the privacy policy: https://www.google.de/intl/de/policies/privacy.
§ 10 Use of Jetpack/formerly WordPress.com-Stats
- This website uses the web analytics service Jetpack (formerly: WordPress.com-Stats) to analyze and regularly improve the use of our website. The statistics obtained allow us to improve our offer and make it more interesting for you as a user. Furthermore, we use the system for measures to protect the security of the website, e.g. detecting attacks or viruses. For the exceptional cases in which personal data is transferred to the USA, Automattic Inc. has submitted to the EU-US Privacy Shield, https://www.privacyshield.gov. The legal basis for the use of Jetpack is Art. 6 para. 1 sentence 1 lit. f GDPR.
§ 11 Integration of Google Maps
- We use the Google Maps service on this website. This allows us to display interactive maps directly on the website and enable you to conveniently use the map function.
- By visiting the website, Google receives the information that you have accessed the corresponding subpage of our website. In addition, the data mentioned under § 3 of this declaration will be transmitted. This happens regardless of whether Google provides a user account through which you are logged in, or if no user account exists. If you are logged in to Google, your data will be directly associated with your account. If you do not wish for your profile to be associated with your Google account, you must log out before activating the button. Google stores your data as usage profiles and uses them for the purposes of advertising, market research, and/or tailoring its website to your needs. Such an evaluation is carried out in particular (even for users who are not logged in) to provide needs-based advertising and to inform other users of the social network about your activities on our website. You have a right to object to the creation of these user profiles, and you must contact Google to exercise this right.
- Further information on the purpose and scope of data collection and its processing by the plug-in provider can be found in the provider's privacy policy. There you will also receive further information about your rights in this regard and settings options for protecting your privacy: https://www.google.de/intl/de/policies/privacy. Google also processes your personal data in the USA and has submitted to the EU-US Privacy Shield, https://www.privacyshield.gov/EU-US-Framework.
§ 12 Use of Google Adwords Conversion
- We use the Google Adwords service to draw attention to our attractive offers on external websites with the help of advertising materials (so-called Google Adwords). In relation to the data from the advertising campaigns, we can determine how successful the individual advertising measures are. Our aim is to show you advertising that is of interest to you, to make our website more interesting for you, and to achieve a fair calculation of advertising costs.
- These advertising materials are delivered by Google via so-called "Ad Servers." For this purpose, we use Ad Server cookies, through which certain parameters for measuring success, such as the display of advertisements or clicks by users, can be measured. If you access our website via a Google advertisement, Google Adwords will store a cookie on your PC. These cookies usually expire after 30 days and are not intended to identify you personally. Typically, the unique cookie ID, the number of ad impressions per placement (frequency), the last impression (relevant for post-view conversions), and opt-out information (marking that the user no longer wishes to be addressed) are stored as analysis values for this cookie.
- These cookies enable Google to recognize your internet browser. If a user visits certain pages of an Adwords customer's website and the cookie stored on their computer has not yet expired, Google and the customer can recognize that the user clicked on the ad and was redirected to this page. Each Adwords customer is assigned a different cookie. Cookies cannot therefore be tracked across Adwords customer websites. We ourselves do not collect and process any personal data in the aforementioned advertising measures. We only receive statistical evaluations from Google. Based on these evaluations, we can identify which of the advertising measures used are particularly effective. We do not receive any further data from the use of the advertising materials, in particular, we cannot identify users based on this information.
- Due to the marketing tools used, your browser automatically establishes a direct connection with Google's server. We have no influence on the scope and further use of the data collected by Google through the use of this tool and therefore inform you according to our level of knowledge: By integrating AdWords Conversion, Google receives the information that you have accessed the corresponding part of our website or clicked on an advertisement from us. If you are registered with a Google service, Google can associate the visit with your account. Even if you are not registered with Google or have not logged in, it is possible that the provider will find out and store your IP address.
- You can prevent participation in this tracking process in various ways: a) by an appropriate setting in your browser software, in particular, suppressing third-party cookies will prevent you from receiving third-party ads; b) by deactivating cookies for conversion tracking by setting your browser to block cookies from the domain "www.googleadservices.com", https://www.google.de/settings/ads, whereby this setting will be deleted if you delete your cookies; c) by deactivating interest-based ads from providers who are part of the "About Ads" self-regulation campaign via the link https://www.aboutads.info/choices, whereby this setting will be deleted if you delete your cookies; d) by permanent deactivation in your browsers Firefox, Internet Explorer, or Google Chrome via the link https://www.google.com/settings/ads/plugin. Please note that in this case, you may not be able to use all functions of this offer to their full extent.
- The legal basis for processing your data is Art. 6 (1) sentence 1 lit. f GDPR. Further information on data protection at Google can be found here: https://www.google.com/intl/de/policies/privacy and https://services.google.com/sitestats/de.html. Alternatively, you can visit the Network Advertising Initiative (NAI) website at https://www.networkadvertising.org. Google has submitted to the EU-US Privacy Shield, https://www.privacyshield.gov/EU-US-Framework.
§ 13 Deletion of Data
- The data processed by us will be deleted or their processing restricted in accordance with Art. 17 and 18 GDPR. Unless expressly stated otherwise in this privacy policy, the data stored by us will be deleted as soon as they are no longer required for their intended purpose and no legal retention obligations prevent their deletion. If the data is not deleted because it is required for other and legally permissible purposes, its processing will be restricted. This means that the data will be blocked and not processed for other purposes. This applies, for example, to data that must be retained for commercial or tax law reasons.
- According to legal requirements in Germany, retention is particularly for 6 years in accordance with § 257 (1) HGB (commercial books, inventories, opening balance sheets, annual financial statements, commercial letters, booking vouchers, etc.) and for 10 years in accordance with § 147 (1) AO (books, records, management reports, booking vouchers, commercial and business letters, documents relevant for taxation, etc.).
§ 14 Data Security
Furthermore, we use appropriate technical and organizational security measures to protect your data against accidental or intentional manipulation, partial or complete loss, destruction, or against unauthorized access by third parties. Our security measures are continuously improved in line with technological developments.
§ 15 Actuality and Amendment of this Privacy Policy
- This privacy policy is currently valid and was last updated in May 2018.
- Due to the further development of our website and offers or due to changed legal or official requirements, it may become necessary to amend this privacy policy. The current privacy policy can be accessed and printed out at any time on the website at [https://ione-software.com/#home].
